Terms & Conditions of Sale
By purchasing from Cosmaroma Inc., the customer agrees to the following Terms & Conditions.
1. Final Sale Items
The following items are FINAL SALE and are not eligible for return, exchange, or refund:
• Custom orders
• Special order items
• Clearance and discontinued merchandise
2. Return Policy
All other merchandise may be returned provided it is unused, unopened, in its original packaging, and in clean, resalable condition. All returns are subject to inspection and approval by Cosmaroma Inc.
Returns made within 60 days of the original purchase date are eligible for a refund to the original method of payment, subject to any applicable processing fees.
Returns made after 60 days are eligible for store credit only unless deemed defective.
Products that have been opened, used, installed, cut, modified, damaged, or are otherwise not in resalable condition are not eligible for return.
Cosmaroma Inc. reserves the right to refuse any return that does not comply with this policy.
3. Inspection of Merchandise
Customers are responsible for inspecting all merchandise before leaving the store.
Vanities, toilets, doors, glass products, and other fragile merchandise must be inspected prior to pickup.
For delivered orders, customers must inspect all merchandise before signing the delivery receipt. Once merchandise has left the store or delivery has been accepted, Cosmaroma Inc. is not responsible for damage, shortages, or missing items.
4. Defective Merchandise
Defective merchandise is subject to inspection. Where applicable, warranty claims for products such as faucets, shower systems, flooring, doors, and similar products shall be handled in accordance with the applicable manufacturer’s warranty.
5. Refund Processing Fees
Refunds issued for purchases originally made using American Express (AMEX) are subject to a 3% processing fee.
Any approved refund exceeding $2,000 is subject to a 2% service fee, regardless of whether the merchandise has been picked up or delivered.
Only a Store Manager may approve returns or refunds exceeding $2,000.
6. Pricing & Ownership
Prices, product specifications, availability, and promotions are subject to change without notice.
All merchandise remains the property of Cosmaroma Inc. until paid in full.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Cosmaroma Inc.’s liability is limited to the purchase price of the product sold.
Cosmaroma Inc. shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the purchase, transportation, installation, storage, or use of any product.
Customers are responsible for ensuring products are suitable for their intended application and are installed in accordance with applicable building codes and manufacturer instructions.
8. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable laws of Canada.
9. Acceptance of Terms
By completing a purchase, the customer acknowledges and agrees to these Terms & Conditions.
